These Terms of Use apply to your use of:

  • our mobile applications ("Applications")

– for iPhone, iPad and other devices using the iPhone OS ("Apple Applications"); and
– for devices using another OS ("Android Applications")

The Website is operated, and the Applications are provided, by FTSE International Limited ("us" or “FTSE”).

Our Apple Applications may be downloaded from the App Store, which is operated and owned by Apple Inc. and other companies within its group ("Apple”). Our Android Applications may be downloaded from Google Play, which is owned and operated by Google Inc. and other companies within its group ("Google").

We will refer to the Website and Applications together as the "FTSE Russell Media" (and by referring to the FTSE Russell Media, we are also referring to the indices, data, information or other material contained in, or accessible via, the FTSE Russell Media).

Your use of the FTSE Russell Media is subject to these Terms of Use. Each time you access or use the FTSE Russell Media you agree to be bound by these Terms of Use as they appear on the Website at the time of your access to or use of the FTSE Russell Media.

We reserve the right to change these Terms of Use and the Privacy Policy from time to time, and without any notice to you, by putting new or revised Terms of Use or a new or revised Privacy Policy on our Website. These Terms of Use were last updated on 26 October 2015. We reserve the right at any time and without notice to change, amend or cease publication of the whole or any part of information included in the FTSE Russell Media.
 

Access to FTSE Russell Media

It is your responsibility to ensure your computer or mobile device meets all the necessary technical specifications to enable you to access and use the FTSE Russell Media. Apple Applications and Android Applications are only licensed for use on a device owned or controlled by you and using the Apple iPhone OS or Android OS (as applicable), so you must make sure that you use an appropriate device to access and use any Apple Application or Android Application. Other Applications may only be used on a device owned or controlled by you running the OS for which the Other Application concerned was designed.

We may, from time to time and without any notice to you, restrict access to or use of certain features, parts or content of the FTSE Russell Media, or the entire FTSE Russell Media.
 

Operation of the FTSE Russell Media

We cannot guarantee the continuous, uninterrupted or error-free availability or operability of the FTSE Russell Media. All rights granted to you under these Terms of Use will terminate immediately in the event that you breach or fail to comply with any of these Terms of Use.

To do anything with the FTSE Russell Media that is not expressly permitted by these Terms of Use, you will need a separate licence from us, Frank Russell Company (“Russell”), FTSE TMX Global Debt Capital Markets Inc. Apple Applications

If the FTSE Russell Media that you access and use is an Apple Application:

  • the Apple Application may be accessed and used only on a device owned or controlled by you and using the Apple iPhone OS;
  • you acknowledge and agree that:

– Apple has no obligation at all to provide any support or maintenance services in relation to the Apple Application. If you have any maintenance or support questions in relation to the Apple Application, please contact us, not Apple, using the contacting us details at the end of these Terms of Use;
– although these Terms of Use are entered into between us and you (and not Apple), Apple, as a third party beneficiary under these Terms of Use, will have the right to enforce these Terms of Use against you;
– except as otherwise expressly set out in these Terms of Use, any claims relating to the possession or use of the Apple Application are between you and us (and not between you, or anyone else, and Apple); and
– in the event of any claim by a third party that your possession or use (in accordance with these Terms of Use) of the Apple Application infringes any intellectual property rights, Apple will not be responsible or liable to you in relation to that claim;

  • you represent and warrant that:

– you are not, and will not be, located in any country that is the subject of a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country; and
– you are not listed on any US Government list of prohibited or restricted parties; and

  • if the Apple Application that you have purchased does not conform to any warranty applying to it, you may notify Apple, which may then refund the purchase price of the Apple Application to you. Subject to that, and to the maximum extent permitted by law, Apple does not give or enter into any warranty, condition or other term in relation to the Apple Application and will not be liable to you for any claims, losses, costs or expenses of whatever nature in relation to the Apple Application or as a result of you or anyone else using the Apple Application or relying on any of its content.
     

Android Applications

If the FTSE Russell Media that you access and use is an Android Application:

  • the Android Application may be accessed and used only on a device owned or controlled by you and using an Android OS;
  • you acknowledge and agree that:

– Google has no obligation at all to provide any support or maintenance services in relation to the Android Application. If you have any maintenance or support questions in relation to the Android Application, please contact us, not Google, using the contacting us details at the end of these Terms of Use;
– although these Terms of Use are entered into between us and you (and not Google), Google, as a third party beneficiary under these Terms of Use, will have the right to enforce these Terms of Use against you;
– except as otherwise expressly set out in these Terms of Use, any claims relating to the possession or use of the Android Application are between you and us (and not between you, or anyone else, and Google); and

Intellectual property rights

All intellectual property rights in the FTSE Russell Media and in any content of the FTSE Russell Media (including, but not limited to, text, graphics, software, photographs and other images, videos, sound, trademarks, service marks and logos) are owned by us or our licensors. The trademarks and service marks used in the FTSE Russell Media (collectively, the " Marks") are trademarks (whether registered or unregistered) and/or service marks owned by FTSE or Russell or members of their group  or by third party licensors. Nothing contained in the FTSE Russell Media should be construed as granting any licence or right to use any of the Marks for any purpose whatsoever without the written permission of, or entry into the applicable licence terms with, the lawful owner.  Unauthorised use of the Marks or any information is strictly prohibited and may violate trademark, copyright or other applicable laws. These Terms of Use shall be governed by English law, and you agree that any dispute between us regarding them or the FTSE Russell Media will be dealt with only by the English courts, provided that, if you are a consumer and not a business user and live in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there. Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court.
 

Severability

If any provision of these Terms of Use is deemed unlawful or are unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the enforceability of the remaining provisions.
